To celebrate brands, TNS Ilres, Regie.lu and IDP agency, hereafter “the partners”, gathered their respective expertise to put together a unique study, revealing which local and international brands influence Luxembourg the most, the “TopBrands”. This document describes how these three partners will process the personal data of persons who contact them or subscribe to their newsletter or other marketing notifications concerning TopBrands. It informs them about their rights concerning these data and explain how to contact the partners for any question or request about the treatment of their personal data. Personal data means any information relating to an identified or identifiable natural person, that is, a person who can be identified, directly or indirectly, by reference to an identifier such as a name, location data, email address or to one or more factors specific to her identity. These will be collected from the TopBrands’ website, whether that follows a contact request, subscription to the newsletter, or registering to know the winning brands in preview. The personal data are those you provide via TopBrands’ website, whether that follows a contact request you made, your subscription to the newsletter, or your registering to know the winning brands in preview. These are also those you will provide in your demand made using main contact details hereabove: a) If you register to know the winning brands in preview, partners will use your e-mail address to send you timely notifications and give you the possibility to connect in exclusivity to attend the virtual awards ceremony. Your first name, last name, company and position will be used by the partners to know more about the people who are interested by their event and to be able to adapt their communication. The legal basis of this data treatment is the legitimate commercial business interest of the partners to provide attractive and value-added services, well adapted to their prospects. b) If you subscribe to the TopBrands’ newsletter, partners will use your e-mail address to send you this communication. The legal basis is the legitimate interest of the partners to provide information about the TopBrands and the services they offer. c) If you contact the partners using the contact form or via any other way, the partners will treat the information provided by you to manage your demand, in the framework of its legitimate interest of management of the requests received. We hope some of these demands will turn in contractual relationship. In such a case, the data will be processed for the implementation, administration and management of the contractual relationship, to the extent that this processing is required for the performance of the contract or for the performance of pre-contractual measures taken at the prospects or clients’ request. At any moment, users can unsubscribe from the newsletter or timely notifications. The partners make available detailed instructions on how to unsubscribe at the bottom of each email or other text message.
All personal data processed by the partners may be sent to their service providers, such as cloud storage providers, accountants or legal advisers, website editing service providers, and other service providers which help the partners to supply services, carry out their business, or to serve the website users. These recipients of personal data are required to comply with legal and/or contractual data protection obligations, including professional secrecy and applicable confidentiality obligations. The partners may also transfer personal data if it is required to do so either by virtue of a legal or regulatory obligation or following an order issued by a public authority within the legal limits.
The personal data will be processed only for the length of time corresponding to the purpose they are used: a) If you only register to know the winning brands in preview, without subscribing to the newsletter or another marketing communication about TopBrands, and do not send any demand to the partners, the personal data you provided for this registration will be erased from the TopBrands’ contact list after the event, at the latest on January, 31, 2021. b) If you subscribe to the TopBrands’ newsletter, your information will be processed until you unsubscribe. c) The personal data processed by the partners to manage demands made via contact form or via any other way will be archived for the time necessary for the recognition, the exercise or the defence of the rights of each partners. In case of contractual relationship, this duration shall be at least ten years concerning the data processed for the implementation, administration and management of the contractual relationship. Please note that this privacy notice concerns only personal data jointly processed for the TopBrands by the partners. If you are in contact with one of these partners (client or any other relationship), this partner probably processes some of your personal data, acting as sole data controller. In such a case, the erasure of your personal data from the TopBrands contact list does not means an erasure of the contact list of the partner with you are in relationship in another context. Please contact him about the data he processes about you.
If your personal data are processed by the partners, thanks to data protection law, you benefit from a right of access, modification, and opposition to personal-data processing, the right to delete personal data, and the right of portability by sending an email to privacy@idp.lu. Theses rights can only be exercised within the limits of contractual and legal obligations of the partners.
